About 40% of drivers exceed the 30 mph speed limit on the city streets according to the study. In my personal experience I have seen speeding frequently.
In a car accident the fact that defendant was speeding can be evidence of that operator’s negligence. Motor vehicle operators are obligated to drive at a safe and reasonable speed. The speed limit within New York City is 30 mph unless otherwise posted.
Although speeding can be considered as evidence of negligence, the fact of speeding may not result in an automatic finding of liability against defendant. In sum, all of the factors have to be considered. However, where a defendant’s speed greatly exceeds 30 mph, the conclusion of negligence can be inescapable.
