Getting a Recovery for Cruise Ship Injuries; The Time Limit for Suit


 

In the last post we discussed the requirement of where a lawsuit be filed.  

In this post we shall discuss the time limit in which to bring suit.

The injured passenger has one year from the date of accident to file a lawsuit.  In addition, the injured passenger must give notice of making a claim within six months of the accident.

The foregoing time periods are contained in the passenger ticket which has been standardized and adopted by the cruise ship industry.

The filing of a claim is satisfied by a lawyer’s letter of representation setting forth some particulars as to the accidents, such as time, place, manner of the accident, and a general statement of injuries.

A client’s failure to adhere to these time limits can result in the dismissal of the case.

Therefore, an injured cruise ship guest should see an attorney immediately after an accident.
